المحكمة «الجنائية الدولية» تؤكد أهليّتها محاكمة سيف الإسلام القذافي

أكّدت المحكمة الجنائية الدولية، أمس الجمعة، أهليّتها محاكمة سيف الإسلام القذافي، نجل الزعيم الليبي الراحل معمر القذافي، بتهم ارتكاب جرائم ضد الانسانية.
وقالت الغرفة التمهيدية الأولى في المحكمة الجنائية الدولية في بيان إنّها قرّرت بالغالبية «اعتبار المحكمة مؤهّلة للنظر بالقضية المرفوعة ضدّه».
وسيف الإسلام القذافي (46 عاماً) مطلوب للمحكمة الجنائية الدولية بتهم ارتكاب جرائم ضدّ الانسانية ابتداءً من 15 فبراير 2011 خلال قمع الانتفاضة الشعبية التي اندلعت ضدّ حكم والده.
واعتقل سيف الاسلام في نوفمبر 2011 في الجنوب الليبي. إلاّ أنّ المجموعة المسلّحة التي تحتجزه أعلنت في يونيو 2017 إطلاق سراحه، لكنّ هذا الامر لم يتأكّد ولا يزال مصيره مجهولاً.
وبحسب النيابة العامّة الليبية فإنّ السلطات القضائية في طرابلس لا تزال تلاحق سيف الإسلام الذي أصدرت محكمة في طرابلس في 2015 حكماً غيابياً بإعدامه لدوره في قمع الانتفاضة ضدّ والده.
ورفض قضاة المحكمة الجنائية الدولية طعناً قدّمه فريق الدفاع عن سيف الإسلام في يونيو الماضي يطلب فيه عدم النظر في القضية لانّ موكّلهم سبق له وأن أدين من قبل محكمة أخرى بنفس التهم، لكنّ المحكمة الجنائية الدولية التي تتّخذ من لاهاي مقراً لها، خلصت الجمعة إلى رفض الطعن انطلاقاً من أنّ الحكم الصادر عن محكمة طرابلس بحقّ القذافي ليس مبرماً، فهو ما زال قابلاً للاستئناف والتمييز، كما أنّه حكم غيابيّ، ما يعني أنّه يمكن إعادة المحاكمة برمّتها.
واعتبرت المحكمة أنّ المبدأ القانوني القائل بعدم جواز محاكمة نفس الشخص بنفس الجريمة مرّتين يفترض أن تكون المحاكمة الأولى قد أتمّت كل طرق الطعن، وهو ما لا ينطبق على حالة سيف الإسلام القذافي.
وكانت المدّعية العامة للمحكمة الجنائية الدولية طلبت في يونيو 2017 اعتقال سيف الإسلام فوراً بعد أن اعلنت المجموعة المسلّحة التي كانت تحتجزه إطلاق سراحه.
وتتّهم المحكمة الجنائية الدولية سيف الإسلام القذافي بأنه «لعب دوراً أساسياً في تطبيق خطة» وضعها والده الهدف منها «قمع الانتفاضة المسلّحة بكل الوسائل».
