خيارات التوازن في الدستور الكويتي* محمد المقاطع

النشرة الدولية –

من يقرأ محاضر المجلس التأسيسي والمذكرة التفسيرية للدستور يبهره دقة وحنكة التوازنات التي تبناها الدستور الكويتي الصادر عام 1962، فقد عمل آباؤنا المؤسسون من الرعيل الأول، بالتعاون مع أمير الكويت آنذاك الشيخ عبدالله السالم- رحمه الله- وبقية أبناء الأسرة الحاكمة من أعضاء المجلس التأسيسي، على وضع دستور عصري وحديث لنموذج محبك في نظامه البرلماني، وفي إرساء التوازن الفريد بين موقع أسرة الحكم من جهة، وبين الشعب من جهة أخرى، وبأحكام تمنع الإفراط أو التفريط من أي طرف منهما فيما هو محدد لهما من دور واختصاصات وصلاحيات في إدارة الدولة، وبيان حدود كل سلطة من السلطات التي أنشأها الدستور، سواء تمثل ذلك بالأمير الذي يأتي من أسرة الحكم باعتبارها مصدراً لإمداد الدولة بالأمير وولي العهد (المادة 4 من الدستور)، أو تمثل بالسلطات الثلاث التي جُعل مصدرها الشعب صاحب السيادة في تسييرها (المادة 6 من الدستور).

 

ونطقت مضابط المجلس التأسيسي والمذكرة التفسيرية للدستور بإبراز كل التوازنات والمواءمات التي تم انتقاؤها بفطنة واقتدار وتراضٍ بعقد اجتماعي، لضمان توازن يحول دون تفرد أي طرف منهما بالصلاحيات وبتصريف شؤون الدولة دون الآخر، وهو ما حرص الدستور على تكريسه بمنع تفرد أي منهما بتعديل أحكامه، فجعله اختصاصاً مشتركاً لكليهما (المادة 174 من الدستور)، كما حرص الدستور على أن يضع ضمانة للحفاظ على ذلك التوازن، فلم يُجِز أن يكون تعديله بالنسبة لموقع أسرة الحكم إلا إذا كان ذلك خاصاً بلقب الإمارة، أو تعديله باتجاه دور الشعب وحقوقه وحرياته إلا إذا كان التعديل نحو المزيد من الحريات والمساواة (المادة 175 من الدستور).

 

وعلى الرغم من حنكة ورضائية خيارات التوازن في الدستور الكويتي، فإن قلة من أبناء الأسرة الحاكمة كانت لديهم آراء تكشف عن عدم قناعتهم بالدستور، ولذلك فضّلوا اعتزال الحياة الدستورية الحديثة، في مقابل تمسك أغلبيتهم بهذه الخيارات وتلك التوازنات التي عززت مكانة الأسرة.

 

ولعل محاضر ومناقشات المجلس التأسيسي تمدنا بالعديد من نماذج خيارات التوازن التي ينبغي تأكيدها، لأنها تمثل حجر الزاوية في متانة نظامنا الدستوري، ونجاحه في حفظ الكويت أمام عاديات الدهر، ومن ذلك:

 

– تبني توارث الحكم في ذرية الشيخ مبارك الصباح بديلاً عن الملكية الدستورية، تعضيداً لأسرة الحكم وتحديداً لمفهومها لتحقيق الاستقرار والاستمرار.

 

– تحديد توازن بين الأسرة والشعب بالمادتين 4 و6 من الدستور.

 

– إبعاد أسرة الحكم عن مجالات التجريح السياسي أو الابتعاد عن منحهم وضعاً مميزاً عن بقية أبناء الشعب، فآثر الدستور خيار المجلس الواحد دون وجود مجلس آخر للأعيان، وهو ما حرصت عليه مناقشات المجلس التأسيسي ودونته المذكرة التفسيرية بشكل صريح، نأياً بالأسرة الحاكمة عن مواضع التجريح لأنها جزء من الشعب.

 

– تبني جوهر النظام البرلماني في المسؤولية الوزارية والاستجواب، مع تقييدها بغايات الرقابة الوطنية من جهة، وخيار عدم التعاون مع رئيس الوزراء دون إسقاطه بسحب الثقة منه، كما هو الشأن بالنسبة للوزراء (بالمادتين 101 و102 من الدستور).

 

– قصر الاختصاصات المالية التي من شأنها أن تُحمّل ميزانيات الدولة أعباء مالية على الحكومة وحظرها على أعضاء مجلس الأمة، لأنها من صميم اختصاص السلطة التنفيذية، ومن الحدود الدستورية المانعة لأعضاء المجلس من تجاوزها (وهو المقرر بالمواد 20، و140، و146، و147 من الدستور).

 

ولا شك أن حفظ خيارات التوازن العديدة التي رسمها الآباء المؤسسون ونطقت بها أحكام الدستور ومواده هي ضمانة الأسرة والشعب لاستقرار الدولة وتجاوز عاديات الدهر، وهو ما أكده التاريخ وحوادثه المتفرقة التي مرت على الكويت منذ تبني دستور 1962 وحتى اليوم.
