وأشار ن.م.ع، البالغ من العمر 31 عام، بمحكمة الأسرة:” سرقت كل الأموال التي كنت أحتفظ بها داخل خزينتي بالمنزل، بسبب موقفي الرافض لقيامها بالإساءة إلي أهلي، وذلك بتحريض من أصدقائها غير المسئولين”.
وتابع الزوج أثناء جلسات تسوية المنازعات الأسرية:” عشت فى عذاب بعد طلبها الطلاق، لأدخل فى دوامة الخلافات الزوجية، وأصبح مهدد بشبح السجن بسبب جبروتها وكراهيتها لأهلي، وحبها للسيطرة، وملاحقتي بالاتهامات الباطلة وتحريض معارفها ضدي بالشهادة الزور”.
يذكر أن القانون المصري حدد شروط للحكم بأن تصبح الزوجة ناشز، وذلك إذا امتنعت الزوجة دون سبب مبرر عن طاعة زوجها، وإذا لم تتعرض الزوجة على إنذار الطاعة خلال 30 يوم، عدم إقامتها دعوى الطلاق أو الخلع، أن لا تثبت أن بيت الطاعة غير ملائم وبعيد عن الآدمية أو مشترك مع أم الزوج أو شقيق الزوج.
