هيئة السوق السعودية تُحيل 5 متلاعبين بأسهم 37 شركة للنيابة خالفوا لائحة السلوكيات

أحالت هيئة السوق المالية، إلى النيابة العامة، 5 مشتبهين خالفوا لائحة سلوكيات السوق، والقيام بممارسات تنطوي على تلاعب وتضليل في التداولات. وأكدت الهيئة في بيان لها أمس أن المتهمين أدخلوا أوامر شراء أو بيع بهدف التأثير على سعر الورقة المالية، والتداول (شراءً) على أسهم عدد من الشركات المدرجة، ثم الترويج لآراء على موقع التواصل الاجتماعي (تويتر) من خلال المعرف (@abukhalidahmid)، ومنتدى هوامير البورصة السعودية من خلال المعرف (بايسون الأسهم) بهدف التأثير على سعر الورقة المالية، ثم قيامهم بالتداول (بيعاً) على أسهم الشركات المدرجة التي تأثرت بالآراء التي تم الترويج لها، حيث شملت حالات الاشتباه قيامهم بالتأثير على أسعار أسهم (37) شركة مدرجة في السوق المالية السعودية خلال الفترة من 20/01 /2020 م وإلى 01 /10 /2020م.

وأوضحت الهيئة أن ذلك يأتي من مسؤولياتها في حماية السوق من الممارسات غير العادلة وغير السليمة، والعمل على تحقيق العدالة والكفاية والشفافية في معاملات الأوراق المالية. وبناءً على المادة السابعة عشرة من نظام السوق المالية.

وشددت الهيئة أنها لن تتوانى في ملاحقة المتلاعبين بالسوق المالية برصد تعاملاتهم استنادًا إلى صلاحياتها وفق نظام السوق المالية، وما تملكه من وسائل تقنية متقدمة تمكنها من رصد كافة التعاملات ومراقبة حالات الاشتباه، وسرعة اتخاذ الإجراءات النظامية اللازمة وفقاً للأنظمة واللوائح، تحقيقًا لأهداف الهيئة نحو تعزيز كفاءة السوق المالية وحماية المتعاملين فيها من الممارسات غير المشروعة وضمان عدم تعرضهم للخداع أو التلاعب.

وأشارت الهيئة أن الأمانة العامة للجان الفصل في منازعات الأوراق المالية، تُعلن للعموم على موقعها الإلكتروني عن هوية المخالفين عند صدور قرارات نهائية من لجان الفصل في منازعات الأوراق المالية في الدعاوى الجزائية، ويحق للمتضرر من هذه المخالفات بعد ثبوتها أن يرفع دعوى على المخالفين للمطالبة بالتعويض أمام اللجنة بموجب المادة السابعة والخمسين من نظام السوق المالية، على أن يسبق ذلك تقديم شكوى للهيئة في هذا الشأن.
